Rue Create – Terms and conditions
By purchasing with Rue Create, you agree that you have read and accepted the terms and conditions outlined below. These terms and conditions apply to any purchases made with Rue Create, including direct enrolments, gift certificates, and voucher purchases. This policy is for all Rue Create enrolments from the 1st of February, 2023.
As guardian and/or parent, I understand that I assume full responsibility for my childs arrival and departure to and from Rue. I understand that Rue shall bear no responsibility for how my child arrives or departs.
Course withdrawal and refunds
Any request to withdraw from a course/class enrolment must be communicated to us in writing via email at www.ruecreate.com. For all withdrawal requests received at least 14 days before the course/class commencement date, we will provide a full refund on your purchased course fees, less a $5 administration fee. For all withdrawal requests received within 14 days before the course/class commencement date, either before the course commencement date, during, or after the course has finished, no other refund or credit will be provided. If you cannot attend a session, we cannot provide you with any credit, refund or replacement class due to our small class sizes. This applies to all term courses, short courses, classes and multi-day workshops. Please consider this carefully before enrolling. Swapping between courses or course deferrals is not accepted due to our small class sizes. Exceptions: At the discretion of Rue Create management, we may provide credit for injury or illness if a current medical certificate can be provided. This will be determined case-by-case basis and ultimately decided by Rue Create. Retrospective requests are not permitted once the course has ended.
All approved refunds will be made via your original payment method and take up to 10 business days to reach your account from the date we have confirmed granting the refund (confirmation will generally take 1-2 days). If the original payment were made via bank transfer, we would request bank account details to issue the refund, and the same time frames will apply.
Class cancellations and numbers
Classes may be cancelled if insufficient enrolments (minimum 3 students) exist. In this instance, a full refund will be offered to
students who have enrolled and paid for any classes cancelled by Rue Create. This refund does not apply to unforeseen events or
catastrophes (please refer below to Force Majeure). A make-up class may be offered as an alternative option in some cases and where available. To ensure students receive sufficient attention in class, classes will not exceed 16 students.
Where a Force Majeure event, such as an unavoidable or unforeseen interruption, occurs to the courses or workshops, Rue
Create may not meet its obligations or may only partially be able to meet them. This includes closure due to disease, government
direction or health department direction. If a course or class(es) are missed due to a Force Majeure event, Rue Create will
endeavour to provide a rescheduled course or class. If a suitable reschedule is not possible, Rue Create may provide a credit or
refund at Management's discretion. However, a credit or refund cannot be guaranteed because of the hardship also experienced
by Rue Create.
Right to Refuse Service
I understand that Rue reserves the right to dismiss me from this Activity and all association with Rue for reasons such as, but not
limited to, signs of illness, disruptive or unsafe behaviour, behaviour unsuitable for the comfort of the classroom environment, or
poor performance at the sole discretion of Rue.
I waive all rights to any legal action against Rue in the event of injury, illness, damages, or loss of personal property not caused by
or resulting from the negligence of the owner or attendees in the studio. Preventative measures will be practised to reduce the
spread of COVID-19 by limiting the number of people in the studio to half our standard capacity (or less), increasing cleaning and
disinfection of area and equipment, and refusing admission to anyone appearing not to be feeling well. Rue staff are trained in
First Aid, essential emergency life support and cardiopulmonary resuscitation. Rue staff have completed CPR, First aid, and Blue
Card and Workers Screening checks.
It is Rue's usual practice to take photographs or record images of students and occasionally to publish limited personal
information (first name) and student materials to celebrate student achievement and promote Rue. Rue owns all photo images
without financial compensation. Rue reserves the right to use these photographs in any print or electronic publications, including
www.ruecreate.com, Rue's social media accounts and newsletters. This form is a record of consent provided to use
images/videos of yourself, a student or artwork unless otherwise stated in writing to Rue. firstname.lastname@example.org
